The short version
Pugamochi is a gentle virtual pet game. It is free to play. Please use it kindly and safely.
You must be at least 13 to create an account. If you are under 18, please ask a parent or guardian if you are unsure about these Terms.
You can submit adventures for possible use in the Community Library. If an adventure is approved, it may appear in other players’ scrapbooks. Please only submit stories and images you created or have permission to use.
Do not include real names, addresses, school or workplace names, contact details, photos of people, or anything personal in submitted adventures.
Pugamochi is not a medical, mental health, or crisis-support service. Its suggestions are optional and are meant to be gentle prompts, not instructions.
Support through Ko-fi is optional. Supporters may get small extras, but everyone still gets the main game.
Please read these Terms carefully. By creating an account or otherwise using Pugamochi, you agree to be bound by them. If you do not agree, you must not use Pugamochi.
1. Definitions
- “Account” means the account registered to a User on the Platform;
- “Adventure” means a story (a title, text, and optional image) that a User submits for possible inclusion in the Community Library;
- “Community Library” means the shared collection of Adventures which, once approved, may appear in other Users’ scrapbooks;
- “Content” means any Adventure or other information a User uploads to or creates on the Platform;
- “Platform” means the Pugamochi game and website, available at https://pugamochi.com/;
- “Pugamochi”, “we”, “us” or “our” means DRMSite Ltd, incorporated and registered in England and Wales with company number 17151917, whose registered office is at 40 Elm Close, Witchford, Ely, CB6 2JH;
- “Supporter” means a User who voluntarily supports the work via Ko-fi (see section 10);
- “Terms” means these terms of use; and
- “User” (“you”) means any person who has registered an Account on the Platform.
2. About Pugamochi
- Pugamochi is a free, gentle virtual-pet game in which you look after a small pug by being encouraged to look after yourself. It offers small, optional suggestions, keeps a scrapbook of your pug’s adventures, and lets you contribute Adventures to a shared Community Library.
- Pugamochi is not a social network and is not designed to create pressure, urgency, or a duty to check in. There is no contact-sharing between Users.
- Nothing in these Terms creates any agency, partnership, joint venture or employment relationship between Pugamochi and any User.
3. Wellbeing suggestions
- Pugamochi may offer small, optional suggestions such as taking a break, noticing something around you, stretching, drinking water, reading, tidying, resting, or contacting someone you like.
- These suggestions are not medical, mental health, therapeutic, or professional advice. You can ignore any suggestion that is not suitable for you.
- If you need medical, mental health, safeguarding, or emergency help, please contact a trusted adult, a qualified professional, emergency services, or an appropriate support service.
4. Eligibility and accounts
- By using the Platform you confirm that you have read, understood and agree to these Terms.
- The Platform is intended for use by consumers only — individuals acting outside their trade, business, craft or profession.
- You must be 13 years of age or over to use the Platform, and by registering an Account you represent that you are.
- If you are under 18, you should make sure a parent or guardian is happy for you to use Pugamochi and to accept these Terms.
- You confirm that the information you provide is accurate and that you will keep it up to date.
- You are responsible for maintaining the confidentiality of your Account credentials and for all activity carried out using your Account.
5. Use of the platform
- You may adopt and care for a pug, accept or ignore suggestions, keep a scrapbook, use the focus timer, and browse Adventures shared into your game.
- You may submit an Adventure to the Community Library. Submitted Adventures are reviewed by a moderator before they may appear in the Community Library.
- If your Adventure is approved, it may be shown to other Users in their own scrapbooks. Approval does not mean we endorse the Content.
6. Acceptable use of the platform
- You must comply with all applicable laws when using the Platform, use it only for its intended purpose, and use it in a way that does not harm other Users.

You must not:
- attempt to gain unauthorised access to the Platform, its servers, or any connected system;
- interfere with, disrupt or impair the operation of the Platform;
- provide false or misleading information, or impersonate another person;
- engage in abusive, unlawful or inappropriate behaviour;
- submit or share any Content that does not comply with our content standards in section 7;
- use the Platform to send unsolicited or unauthorised advertising or promotional material, or to promote unrelated services;
- reproduce, modify, adapt, distribute or publicly disseminate the Platform or its content except as expressly authorised by us in writing;
- decompile or reverse engineer the Platform;
- knowingly introduce viruses, trojans, worms, or other malicious or technologically harmful material;
- attack the Platform via a denial-of-service or distributed denial-of-service attack (doing so would be a criminal offence under the Computer Misuse Act 1990); or

conduct, facilitate or permit any text or data mining or web
scraping in relation to the Platform, including using:
- any robot, bot, spider, scraper or other automated tool to access, copy, monitor or republish any portion of the Platform or its Content; or
- any automated technique aimed at analysing text and data to develop, train, fine-tune or validate AI systems or models.
- For clarity, paragraph 6.2(k) does not restrict standard search-engine indexing, assistive or accessibility technologies you use to access the Platform, or security testing that we have authorised in writing.
7. Content and moderation
- Our Safety & Moderation policy explains, in plain language, what may and may not be shared, how we review Adventures, and how to report Content. It forms part of these terms.
- Users are solely responsible for the Content they submit. Although we review Adventures before they appear in the Community Library, we do not guarantee to identify or remove all unlawful, inaccurate or inappropriate Content, and Content shared by other Users does not represent our views or values.

You warrant that any Content you submit:
- is accurate and not misleading;
- complies with applicable law;
- does not infringe the rights of any third party; and
- is your own, or something you have permission to use.

Content must not:
- be defamatory of any person;
- contain the personal data of any other person;
- be obscene, offensive, hateful or inflammatory;
- be threatening, abusive, or invade another’s privacy, or cause needless anxiety;
- be likely to harass, upset, embarrass, alarm or annoy any other person; or
- advocate, promote or incite any unlawful or criminal act.

Adventures submitted to the Community Library must also follow our
adventure guidelines. In particular, a submitted Adventure must not:
- include personal or identifying information about you or anyone else;
- include real children, schools, uniforms, addresses, or contact details;
- use copyrighted characters, or copy someone else’s story or image;
- be distressing, frightening, cruel, or perilous, or feature threats, abandonment, punishment, death, or harm; or
- where an image is included (images are optional), contain anything unsafe, or any text, captions, interface, or watermarks — an image should be safe and relevant to the story.
- We may reject, remove or restrict any Content, and refuse or withdraw an Adventure, at our discretion. Any rights granted in respect of Content are set out in section 8 (“Intellectual property”).
- Reporting content. If you see an Adventure or other Content that you think is unsafe, unlawful, inappropriate, copied, or includes personal information, please contact us at pugamochi@drmsite.com. We may remove or restrict Content while we review it.
8. Intellectual property
- Pugamochi is the sole owner of all intellectual property rights relating to the Platform, its contents and all related software and databases, except for Content provided by Users.
- We grant you a non-exclusive, personal and non-transferable licence to use the Platform for personal, non-commercial purposes. You are prohibited from any other use or exploitation of the Platform without our prior written permission.
- Your Content. You keep ownership of any Adventure or other Content you submit. This section applies to Content you submit (such as Adventures) — not to your private game data, such as your pug’s name and appearance or your own scrapbook.
- By submitting Content, you give Pugamochi a non-exclusive, worldwide, royalty-free licence to host, store, copy, review, moderate, format, display, and make that Content available as needed to operate the Platform.
- If your Adventure is approved for the Community Library, you also give Pugamochi permission to show it to other Users inside the game, including in their scrapbooks.
- This permission continues for approved Adventures that have already been shared into Users’ scrapbooks, so that existing scrapbook entries do not break if you later delete your submission or your account. We will stop newly sharing a deleted Adventure where reasonably practical.
- Other Users may view approved Adventures inside Pugamochi only. They do not receive permission to copy, publish, sell, or reuse your Adventure outside the Platform.
- We will not use your submitted Adventure in external marketing or promotional materials without your separate permission.
9. Platform operation and availability
- The Platform is provided on an “as is” and “as available” basis.
- We do not promise that Pugamochi will always be available, uninterrupted, secure, or error-free, or that Content or game data will never be lost. This does not affect any rights you have under consumer law.
- We may modify the Platform at any time. Where a change is expected to materially and detrimentally alter its functionality, we will, where reasonably possible, give reasonable notice in advance (except where a change must be made immediately to comply with law, in an emergency, due to an event outside our control, or to prevent harm).
- We may suspend or withdraw the Platform at any time; we will try to give reasonable notice.
10. Supporting the work (Ko-fi)
- Pugamochi is free to play. You may choose to support the work voluntarily through Ko-fi. Support helps fund hosting, storage, moderation, testing, maintenance and development. Support is handled by Ko-fi and may also be subject to Ko-fi’s own terms.
- Unless clearly stated otherwise, donations and monthly support are a way to help sustain the work, not a purchase of a guaranteed product, service, delivery schedule or fixed set of rewards.
- Supporters may receive small, optional extras (such as occasional updates, early previews, supporter polls, or priority review of submitted Adventures). Any benefits may vary, may change over time, and may be removed if your support ends. Supporters do not receive a “better pug” or any gameplay advantage — the main game stays the same for everyone.
- Priority review means a submitted Adventure may be reviewed sooner. It does not guarantee approval, and all Adventures must still meet the same safety, quality, and moderation standards.
- Monthly support can be cancelled through Ko-fi at any time. If your support ends, supporter extras may pause or end, but this will not affect your access to anything otherwise freely available.
- Supporting does not guarantee that any particular feature, request or idea will be built. Refunds may be considered where something has gone wrong, but are not guaranteed for donations or past months of support already processed. If something has gone wrong, please contact us. This does not affect any rights you have under consumer law.
11. Suspension and enforcement
- We may suspend or remove Users, or restrict access to features or Content, at any time where we reasonably believe that a User has breached these Terms, poses a risk to others, or has used the Platform unlawfully or in bad faith. Where possible we will act fairly and proportionately.
12. Limitation of liability
- To the fullest extent permitted by law, we shall not be liable for any loss or damage arising from your use of the Platform, including loss of Content or game data, unavailability of the Platform, or reliance on any Content submitted by other Users.

Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any liability which cannot lawfully be limited or excluded.
- Nothing in these Terms affects any rights you have under consumer law that cannot legally be excluded or limited.
- We only provide the Platform for domestic and private use. You agree not to use it for any commercial or business purpose, and we have no liability to you for any loss of profit, business, or business opportunity, or for any indirect or consequential loss.
- We are not liable for losses that are not caused by our breach or negligence, nor for losses that were unforeseeable, caused by an event outside our control (where we have used reasonable endeavours to minimise the effects), or which you could reasonably have avoided.
13. Data protection
We process personal data in accordance with our Privacy Policy.
14. Changes to these terms
- We may amend these Terms from time to time to reflect changes to the Platform, the law, or our practices. Where changes are material, we will, where reasonably possible, give reasonable notice by posting the updated Terms on the Platform and/or notifying you via your Account or by email.
- The updated Terms take effect from the date specified or, if none, when published on the Platform. If you do not agree to the updated Terms, you must stop using the Platform; continued use after they take effect constitutes acceptance.
15. General
- Neither party is liable for any failure or delay caused by circumstances beyond its reasonable control.
- You acknowledge that you have not relied on any statement or representation not expressly set out in these Terms.
- If a court finds any part of these Terms unlawful, the rest will continue to apply.
- This contract is between you and us; nobody else can enforce it.
- We may transfer our rights and obligations under these Terms to another organisation; we will tell you in writing and this will not affect your rights.
- Even if we delay in enforcing these Terms, we can still enforce them later.

17. Governing law
These Terms, their subject matter and their formation are governed by English law. We both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland you may also bring proceedings in Scotland.
